By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

THESE TERMS AND CONDITIONS CONTAIN A DISPUTE RESOLUTION CLAUSE THAT IMPACTS YOUR RIGHTS ABOUT HOW TO RESOLVE DISPUTES. PLEASE READ IT CAREFULLY.

OUR PLATFORM SOLELY OFFERS PRESCRIPTION DISCOUNTS AND PRICING INFORMATION AND DOES NOT ENGAGE IN PROVIDING MEDICAL (TELEHEALTH), DENTAL, OR ANY OTHER HEALTH-RELATED SERVICES. ADDITIONALLY, WE DO NOT OFFER INSURANCE OF ANY KIND. IT IS YOUR RESPONSIBILITY TO PROVIDE PAYMENTS TO PHARMACIES WHERE YOU OBTAIN PRESCRIPTION DISCOUNTS. SINCE WE DO NOT PROVIDE ANY MEDICAL, DENTAL, OR HEALTH-RELATED SERVICES, WE BEAR NO LIABILITY OR RESPONSIBILITY FOR THE PROVISION OR ABSENCE OF SUCH SERVICES.

Intellectual Property
All content published and made available on our Site is the property of Franklin Technology Services LLC DBA LowerMyRx and the Site’s creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

Age Restrictions
The minimum age to use our Site is 18 years old. By using this Site, users agree that they are over 18 years old. We do not assume any legal responsibility for false statements about age.

Acceptable Use

Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless Franklin Technology Services LLC DBA LowerMyRx and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law
These Terms and Conditions are governed by the laws of the State of New Jersey.

Dispute Resolution
Subject to any exceptions specified in these Terms and Conditions, if you and Franklin Technology Services LLC DBA LowerMyRx are unable to resolve any dispute through informal discussion, then you and Franklin Technology Services LLC DBA LowerMyRx agree to submit the issue before a mediator. The decision of the mediator will not be binding. Any mediator must be a neutral party acceptable to both you and Franklin Technology Services LLC DBA LowerMyRx. The costs of any mediation will be shared equally between you and Franklin Technology Services LLC DBA LowerMyRx.

Notwithstanding any other provision in these Terms and Conditions, you and Franklin Technology Services LLC DBA LowerMyRx agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.

No Medical Advice

The services provided by LowerMyRx are NOT intended to diagnose or treat any medical issues or conditions. If you think you have a medical problem or condition, it is essential to reach out to a qualified healthcare professional without delay. For those in the United States experiencing a medical emergency, please dial 911 or seek urgent medical assistance.

Our Services

The Card offered by LowerMyRx is a discount program, NOT insurance. It is not meant to replace health insurance but instead provides discounts on prescription drugs and pharmaceutical products at participating pharmacies. The extent of these discounts may vary based on the product and pharmacy. You are responsible for covering all prescription drug costs at the time of purchase, as LowerMyRx does not make payments to pharmacies or healthcare providers.

You can obtain a Card without registering or creating an account by either printing or downloading it. Alternatively, you may have received one from a third-party sponsor. If you request a card via email, text, or mail, you must provide your name, email address, home address, and/or phone number. This information will be used in accordance with our Terms and Privacy Policy.

To access the Services through the App, download it from the Apple iTunes App Store or Google Play Store, subject to the relevant end-user license agreement.

If you do not have health insurance, the Card can be used for any brand name or generic prescriptions that you or a household member pay for out-of-pocket, unless other restrictions apply. It cannot be used with other prescription drug discount cards or alongside health plan/pharmacy benefit plan payments. For those with health insurance or other funded benefits like Medicaid and Medicare, the Card can be used for specific prescriptions not covered by your plan.

To receive the LowerMyRx discount, present the Card for each prescription at a participating pharmacy. You will pay the lower amount between the LowerMyRx discounted price and the pharmacy’s retail price. If the retail price is lower, no discount applies. Discounts are only available at participating LowerMyRx pharmacies, and pricing and benefits are subject to change without notice.

Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
